Export packaging for pipe decides who pays when a container lands damaged. The nine clauses to write into a PP-R purchase order, and what proves each one.

Export packaging is the only line on a pipe purchase order that most importers never write. The pipe specification runs to half a page. The payment terms run to a paragraph. Packaging gets one word, usually "standard", and the container is loaded to whatever the factory happens to do that week.

That single word is doing more work than the buyer thinks. Under the Hague-Visby Rules, insufficiency of packing is one of the carrier's listed defences, and insufficiency or inadequacy of marks is a second one sitting right beside it. The cargo policy carries the same idea: Institute Cargo Clauses (A) clause 4.3 excludes damage caused by packing that could not withstand the ordinary incidents of the transit. So the failure mode is not simply that pipe arrives crushed. It is that crushed pipe arrives and nobody is obliged to pay for it.

Before the clauses, a look at what a stack of pipe is actually resisting. The clip below is IFAN's own extrusion-resistance test on a PP-R elbow, where a press loads the fitting until it deforms. Packaging Is a Liability Instrument Before It Is a Cost Line

Start with the two lists nobody in this trade reads. The Hague-Visby Rules set out seventeen circumstances in which the carrier is not responsible for loss or damage. Two of them are about your packaging. Rule 2(n) of Article IV reads, in full, "Insufficiency of packing." Rule 2(o), the next line down, reads "Insufficiency or inadequacy of marks." They are separate defences because they fail in separate ways. Both are argued against a short clock: written notice of damage that is not apparent is due within 3 days of delivery.

The insurance side mirrors it. Institute Cargo Clauses (A), the 2009 wording used across most all-risks cargo policies, excludes at clause 4.3 any "loss damage or expense caused by insufficiency or unsuitability of packing or preparation of the subject-matter insured to withstand the ordinary incidents of the insured transit where such packing or preparation is carried out by the Assured or their employees or prior to the attachment of this insurance". The clause then adds a definition that matters more than the exclusion: for these clauses, "packing" is deemed to include stowage in a container. How the pipe was stacked inside the box is packing, not carriage.

Two consequences follow, and both are commercial rather than legal. First, an importer buying on CIF is often thinly covered before anything goes wrong: the International Chamber of Commerce states that under CIF the Institute Cargo Clauses (C) remains the default level of cover, while CIP requires cover at Clauses (A) level. Clauses (C) is a named-perils set. Second, the exclusion bites hardest when the packing was done by the seller before the policy attached, which is exactly the shape of a factory-loaded container.

None of this is legal advice, and the regime that applies to a given shipment depends on the contract of carriage, the bill of lading terms and the jurisdiction. Confirm your own position with your broker or a maritime lawyer. What is not in doubt is the direction of travel: packaging sits in the causation chain, and both the carrier and the insurer are entitled to point at it.

What Your Bill of Lading Calls a Package Decides What You Can Recover

Suppose the packaging holds and the damage is the carrier's fault anyway. There is still a ceiling. Article IV rule 5(a) caps liability at 666.67 units of account per package or unit, or 2 units of account per kilogramme of gross weight of the goods lost or damaged, whichever is the higher. The unit of account is the IMF Special Drawing Right, and the IMF publishes its value daily.

Rule 5(c) is where packaging turns into money. "Where a container, pallet or similar article of transport is used to consolidate goods, the number of packages or units enumerated in the bill of lading as packed in such article of transport shall be deemed the number of packages or units". Then comes the sentence that costs importers real sums: "Except as aforesaid such article of transport shall be considered the package or unit." A bill of lading that says 1 x 40' container, said to contain PP-R pipe has described one package.

Run the arithmetic on a 10,000 kg loss, which is a worked-example figure and not a claim about any real shipment. The weight limb gives a flat 20,000 SDR. The package limb gives 667 SDR for one enumerated package, 13,333 SDR for twenty, and 66,667 SDR for a hundred. Those two limbs cross at thirty. Below thirty enumerated packages the flat weight limit is what you get and the description changes nothing. Above it, every bundle and carton named on the bill of lading raises the ceiling.

Enumeration is a packing-list question long before it is a bill-of-lading question. If the packing list says "PP-R fittings, assorted", the carrier has nothing to enumerate. If it says "412 cartons, each 200 pcs", it does. The moment to fix this is when the proforma invoice is agreed, not when the surveyor arrives.

Two Marking Layers, and the Carrier Only Reads One

Pipe carries two independent sets of marks, written by different standards for different readers, and buyers routinely check only the first.

Layer one: the print line on the pipe

ISO 15874-2:2013 sets the minimum required marking for PP-R pipe at eight aspects. Five of them identify the product: the standard number, the manufacturer's name or trade mark, nominal outside diameter and wall thickness, the pipe dimension class, and the material. Three more qualify it: the application class combined with operating pressure, opacity where declared, and the manufacturer's information giving production period and production site. How it appears is fixed too. Marking details "shall be printed or formed directly on the pipe not less than once per metre", so identity repeats at intervals of no more than 1 m. Printed colour must differ from the pipe's own colour, and the size must be legible without magnification.

This layer identifies the goods. It survives cutting, and it is what the print line on a PP-R pipe is for.

Layer two: the handling symbols on the outer package

ISO 780:2015, now in its fifth edition and titled Packaging — Distribution packaging — Graphical symbols for handling and storage of packages, governs the second layer. Its symbol set runs to seventeen marks, and four of them decide how a bundle of pipe is treated in a hot, wet port: Keep away from rain, Keep away from sunlight, Stacking limit by number, and Do not stack. Placement is part of the requirement. The fragile symbol belongs near the upper corner on all four upright sides, or on a minimum of two upper corners, and This way up follows the same rule.

The standard is explicit that symbols should be used only when necessary, so a wrap covered in every available icon communicates nothing. Pick the four that apply and put them where a forklift driver looking at one face will see one. That is also the practical reading of Article IV rule 2(o): a mark on the face nobody looks at is inadequate marking.

Checking only layer one is the common error. Layer one settles a specification argument with the supplier; layer two is the layer a carrier points at when it declines a claim, and it is the one that disappears when a bundle is re-wrapped at the port.

Bundling, End Capping and the Mixed-Size Container

Here is the honest part. No international standard sets a strap interval for plastic pipe, a bundle count, a film thickness or a cap type. The IMO, ILO and UNECE published the 2014 Code of Practice for Packing of Cargo Transport Units, and it is the reference every surveyor reaches for, but it is a non-mandatory code of practice about packing and securing in general. It will not tell you how many straps a bundle of DN110 needs.

So stop trying to specify the method and specify the outcome plus the evidence. Four requirements do most of the work:

  • A bundle that survives being lifted by one end. The test is whether the bundle can be moved by the equipment at the destination port, not whether it looked tidy at the factory gate.
  • Closed pipe ends. Aquatherm's installer manual puts the mechanical reason plainly: do not insert sharp or unpadded objects into the ends of the pipe, because this gouges the inside and creates weak spots. An open end in a container is an invitation for exactly that, plus dust, water and insects.
  • A carton or bundle count that matches the packing list line for line. This is the enumeration point again, arriving as a packing instruction.
  • Photographs of the loaded container before the doors close, dated, with the bundle marks legible in the frame.

The mixed-size container is where this gets difficult, and it is the normal case rather than the exception. IFAN's stated minimum order is one container with mixed sizes accepted, across a range that runs DN20 to DN160 in PN12.5 to PN25 and more than 3,000 PP-R SKUs. A container holding fourteen diameters in four pressure classes has fourteen bundle types that look similar from three metres away. Sizes get separated at the yard by whoever unloads them, and once separated without marks they are separated permanently.

Ask the supplier for their written packing specification before the first order, and read it against the four requirements above. If no written specification exists, that answer is itself information about the factory, and it belongs in your supplier scoring rather than in a hopeful email.

Wood in the Load Is a Border Question

Plastic pipe is not a phytosanitary risk. The pallet under it is. ISPM 15, the IPPC standard for wood packaging material in international trade, is the reason a container of PP-R can sit at a border while nothing inside it is at fault.

The treatment parameters are specific. Conventional heat treatment, marked HT, means 56 °C for a period of 30 continuous minutes throughout the profile of the wood. Dielectric heating, marked DH, means 60 °C for 60 seconds through the profile. Methyl bromide fumigation carries the code MB. The mark itself must carry four elements: the IPPC symbol, the ISO two-letter country code, the control number of the facility authorised by the national plant protection organisation, and the treatment abbreviation. It must be permanent, legible without visual aids, applied where it can be seen, and it may not be hand drawn.

Two exemptions save a lot of argument. Wood thinner than 6 mm is outside the standard, and packaging made wholly of processed wood products such as plywood, oriented strand board, fibreboard, press board and cardboard does not need treatment or marking. Where a unit mixes treated solid wood with processed material, the solid-wood component carries the mark.

The practical version for a pipe order runs to three lines. Name the pallet and dunnage material in the purchase order. Require the ISPM 15 mark on every solid-wood item, end frames and corner boards included, and ask for a photograph of one legible mark before the container is sealed. Destination requirements vary by country and change, so confirm the current position for your market with your customs broker. After the Doors Open: Yard Storage in a Hot Port

Clearance is not the end of the transit risk. It is the start of a storage period that the buyer controls and usually mismanages, and PP-R has one published vulnerability that matters here.

Aquatherm's technical bulletin on UV protection states that prolonged exposure to UV radiation "will discolor bare PP-R or RP (RCT) pipe and could weaken the polymer over time". Read the next part carefully, because it is what separates an honest article from a confident one: the bulletin gives no maximum permitted exposure period, and no manufacturer consulted for this article publishes one. Anyone who tells you PP-R is good for six months in the open has invented the number. Treat exposure as something to minimise rather than something to budget.

The same manufacturer's installer manual is specific about how. Keep the pipe in its protective wrap until it is needed, because the bag protects it from dirt and scratches. Cover pipe stored outside with a light tarp. The instruction then names the failure mode nobody expects: a dark tarp generates heat and can cause warping. Black plastic sheet over a stack of green pipe in a Lagos or Mombasa yard is worse than leaving it uncovered, and it is what most yards reach for first.

Surface area decides how fast this matters. A stack of DN160 pipe, 160 mm across, presents far more skin to the sun than a pallet of DN20. Two of the ISO 780 symbols exist precisely for this window. Keep away from sunlight and Keep away from rain are instructions to the yard, not to the ship. If the outer wrap arrived carrying them, the storage argument has already been made on your behalf.

The Packaging Clause Set: What to Write Into the Purchase Order

This is the section to copy out. Nine clauses, each one tied to the rule it protects and to the evidence that shows it was honoured. None of them requires the supplier to buy new equipment, and each is verifiable before the container is sealed.

Where We Stop: What This Guidance Cannot Tell You About a Factory

Everything above is drawn from published rules and one named manufacturer's published instructions. None of it is a description of how any particular factory packs, because that document is not public for any supplier in this trade, IFAN included. The clause set exists to make a supplier produce theirs. Treat a written packing specification the same way you treat a batch certificate: something you require and read, not something you assume.

One caution on the last clause. A supplier with no written packing specification is not necessarily a bad supplier, but a supplier who will not put one in writing after being asked is telling you something. IFAN, for example, publishes what it declares against on its PP-R supply page: DIN 8077/8078 and ISO 15874, 100% virgin PP-R material, and a batch certificate with each shipment. Documentation habits at that level are the ones to test against a packing annex.

The First Hour: Three Scenarios and What Each One Proves

The container is open and something is wrong. What you photograph in the next hour decides which of the clauses above pays for it. Three situations cover most of what actually happens to pipe.

Scenario one: crushed bundles at the door end

A mixed-size load has settled and the bottom tier nearest the doors is deformed. Photograph the stack before anything is moved, with the seal intact in one frame. Then photograph the strapping: intact straps on a collapsed bundle point at the stow, while broken straps point at handling. The distinction is the difference between a packing exclusion under Clauses 4.3 and a carriage claim.

Scenario two: contamination inside uncapped pipe

Open ends collect dust, water and sometimes insects. Photograph the bore of several pipes from the same bundle and note whether the affected pipes are the outer ones. If the ends were capped and the caps are missing, that is a different fact from ends that were never capped at all, and the packing photographs required by clause two of the table settle it in seconds.

Scenario three: illegible marking on part of the consignment

Wrap has torn and a group of bundles now carries no SKU. Before the sizes are separated, photograph the group with a tape measure across a pipe end and record the print line from the outermost pipe of each bundle. That print line is required at least once per metre under ISO 15874-2, so identity is recoverable even when the outer marking is gone. This is why clause eight of the table asks for the pipe marking to be legible on the outermost pipe.

All three scenarios share a clock. Written notice to the carrier is due before or at the time of removal of the goods, or within 3 days where the damage is not apparent, and suit within 1 year of delivery. A last note on volume. Loading efficiency and packaging quality pull against each other, and the trade-off is worth understanding before you specify either; the arithmetic of how much pipe fits a 20ft or 40ft container is where that balance is set.

Conclusion

Write the packaging clauses into the order and the rest follows, because every clause in the table above is verifiable before the container is sealed and worthless afterwards. Run five checks on your next purchase order. Does the packing list enumerate cartons and bundles by count? Does every bundle carry SKU and pressure class? Is all solid wood ISPM 15 marked and legible? Do the ISO 780 symbols sit on a face a forklift driver will see? And is the supplier's packing specification attached as an annex? The answer flips if you are buying ex-works and packing the container yourself, in which case the exclusion at Clauses 4.3 lands on you rather than the seller.

If you are preparing a first order with a new supplier, review your draft packing annex against their published specifications before the proforma is signed. It is a cheaper conversation than the one that starts with a photograph of a collapsed bundle.
